Terms of Service

Introduction

These Terms of Service (“Terms”) outline the rules and conditions for using the website (www.getinfluencewith.com), mobile application, and web application (collectively, “Platform”) operated by Influence With U.K Ltd (“InfluenceWith,” “we,” “our,” or “us”). By accessing or using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not accept these Terms, you must not use the Platform.

Accounts & Access

  • You must be at least 18 years old to create an account.
  • Users under 18 may use the Platform only under parental or legal guardian supervision.
  • Users must provide accurate and complete information when registering and maintain the security of their account credentials.
  • InfluenceWith reserves the right to suspend or terminate accounts for violations of these Terms.

3. 

Acceptable Use

Users agree not to:
  • Engage in fraudulent, misleading, or illegal activities.
  • Harass, impersonate, or mislead others.
  • Use the Platform for unauthorized commercial purposes.
  • Upload content that violates applicable laws, infringes intellectual property, or spreads misinformation.

4. 

Payments

  • Payments are securely processed through third-party providers such as Stripe.
  • Users are responsible for applicable taxes and fees.
  • InfluenceWith does not store full financial details.
  • Refund policies and payment disputes are subject to third-party provider terms.

5. 

User Content & Rights

Users retain ownership of the content they upload to the Platform, including profile pictures, intro videos, music, and other media. By uploading content, users grant InfluenceWith a non-exclusive, worldwide, royalty-free license to use, display, and distribute it within the Platform. InfluenceWith may also use users’ intro videos or public profile information in advertisements online and offline worldwide, royalty-free. We will not disclose personal data but may use publicly available profile information in marketing or social media content.

User-Generated Content
User-generated content sold to customers is subject to specific usage rights between the influencer (seller) and the customer (advertiser). There are two types of content usage rights:

Social Media Usage Rights:
  • The advertiser may use the content on social media platforms for promotional purposes, including sharing, reposting, and using it in ads or posts.
  • The customer may use the content on their social media profiles and enable advertising (e.g., YouTube Ads), with ad revenue belonging to the customer.
  • The customer cannot sell the content to a third party, but they may edit it for their own promotional use.

Custom Usage Rights:
  • The advertiser and seller may mutually agree on custom usage rights in the QuickAd proposal or direct job proposal form.
  • These rights are agreed upon before purchase and dictate how the advertiser can use the content beyond the default social media usage rights.
  • InfluenceWith does not own this content, as it was purchased by the customer with agreed-upon rights directly between the influencer and the customer.
  • Users must ensure they have the necessary rights to any content they upload or sell through the Platform.
  • InfluenceWith reserves the right to moderate or remove content that violates these Terms.

6. 

Content & Enforcement

  • InfluenceWith may monitor, moderate, and remove content that violates these Terms.
  • Users can report violations through the Platform’s reporting tools.
  • InfluenceWith reserves the right to restrict or suspend accounts involved in repeated violations.

7. 

Termination

  • InfluenceWith may terminate or suspend accounts for violations of these Terms or legal requirements.
  • Users may request account deletion by contacting support or submitting a request via their settings in the mobile app. This applies to accounts across the website, mobile app, and web app.
  • Termination does not absolve users from outstanding payment obligations.

8. 

Privacy & Data Usage

  • Data is collected for purposes such as authentication, fraud prevention, and service improvements.
  • Users can exercise their data rights under GDPR and other applicable regulations.

9. 

Cookies & Tracking

  • Users can manage their cookie preferences via browser settings or the Platform’s consent management tools.

Disclaimers & Limitations

  • InfluenceWith does not guarantee uninterrupted or error-free access to the website, mobile app, or web app.
  • InfluenceWith is not liable for indirect, incidental, or consequential damages arising from Platform use.

11. 

Indemnification

  • Users agree to indemnify and hold harmless InfluenceWith from any claims, damages, or legal fees arising from Platform use or violation of these Terms.
  • InfluenceWith is not responsible for disputes between users and third parties.

12. 

Third-Party Services

  • InfluenceWith integrates third-party services such as payment processors, analytics providers, and content moderation tools.
  • Users acknowledge that third-party terms and privacy policies apply when interacting with these services.

13. 

Legal & Disputes

  • These Terms are governed by the laws of England.
  • Disputes shall be resolved exclusively in the courts of England.

14. 

Updates to Terms

  • InfluenceWith may update these Terms periodically.
  • Continued use of the website, mobile app, or web app after updates constitutes acceptance of the revised Terms.
